Sherwin-Williams Automotive Finishes Spray to Win Competition (2020) Terms and Conditions


  1. Competition conductor: The Sherwin-Williams Automotive Finishes Spray to Win Competition (2019) (Competition) will be conducted by Valspar Automotive Pty Limited ABN 41080461230 (Promoter) during the Competition Period (defined below).

  2. Deemed acceptance: Entry into the Competition is deemed acceptance of these terms and conditions (as amended from time to time).

  3. Change to terms and conditions: These terms and conditions may be amended or replaced by the Promoter in its absolute discretion and at any time. Any such amendments will be posted on the Competition website at participation in the Competition will be deemed acceptance of such amendments.

  4. Eligibility: To be eligible to enter the Competition entrants must fulfil the following criteria:

    1. Be a resident of Australia or New Zealand; and

    2. Be over the age of 18; and

    3. Employed in the Smash Repair Industry (Entrants).


Employees of the Promoter, their associated agencies, suppliers or related bodies corporate, and their immediate families are not eligible to enter this Competition.

  1. Your personal information: The personal information you provide in the Competition form will be used in accordance with the Promoter's Privacy Policy available at its website, including to facilitate the Competition, administer Prizes, maintain contact with Entrants and keep Entrants up-to-date with information about the Promoter, its products, services and events. Entrant's personal data will not be disclosed to third party organisations, except where required by law by government regulatory authorities. If you do not wish to receive this information, for your information to be used in this way, or if you would like your name to be removed from our database please contact the Promoter. Our Privacy Policy tells you how we collect and use your personal information, how you can contact us to request access to or correct information we hold about you and how to complain about a potential privacy breach.

  2. Change of personal details: Each Entrant is responsible for notifying the Promoter of any changes to his/her residential address, email address or phone number during and after the Competition Period.

  3. Competition entry: Entrants must during the Competition Period:

  1. Provide a photo of a job that used Valspar Automotive product (eg. DeBeer Refinish, Valspar Refinish or Valspar Industrial Mix).

  2. List the products that were used to complete the job and where the Entrant purchased their paint;

  3. submit entry via the form on  (Entry) Entrants may submit multiple entries during the Competition Period.

  1. Competition Period: The Competition commences on Monday, 17th August 2020 at 09:00:00 AEST and concludes on Sunday 13th September 2020 at 23:59:59 AEST (Competition Period). No responsibility is accepted for late, lost or misdirected Entries.

  2. Selecting Winners:. The Promoter will judge all Entries and will select three winners with the most creative and original Entries. The first winner will win First Prize. Second winner will win Second Prize and third winner will win Third Prize. The Entries will be judged by the Promoter on 15th September 2020 at the offices of the Promoter at Unit 11, 8 Kerta Rd, Kincumber, NSW 2251 (Judging Period).

  3. Prizes: There are three prizes in total to be awarded.

  1. First Prize :

One Premium Beefmaster 4 Burner BBQ with Side Burner AND One $50 Coles Group Gift Card

Prize value is $999AUD RRP.

  1. Second Prize:

One Custom Laser Cut Fire Pit AND One $50 Coles Group Gift Card
       Prize value is $550AUD RRP.

C.   Third Prize:

 One Customised 70L Outermark Premium Icebox Cooler AND One $50 Coles Group Gift Card
      Prize value is $210 RRP.


  1. Notifying Winners: The Winner will be notified of the judging results by Facebook post or email within 3 days of the Judging Period. If a Winner cannot be contacted or do not claim their Prize, within one week of the Winner being notified, the Prize will be forfeited and will be awarded to the next best Entry as determined by the Promoter.

  2. Original Entry: Each work submitted as an Entry or part of an Entry (“Work”) becomes the property of the Promoter.

Work(s) will not be returned to any Entrant. As a condition of Entry, each Entrant irrevocably grants to the Promoter a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including without limitation, copyright) in and to the Work and consents to the Promoter doing (or omitting to do) any acts in respect of the Work which may otherwise constitute an infringement of the Entrant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of an Entrant’s Work(s) for any purposes at its discretion, including, without limitation, using   the Entrant’s Work(s) for promotional, marketing or publicity purposes, whether in respect of this Promotion, the Promoter, or otherwise. Each Entrant warrants to the Promoter that the Work submitted is an original literary work of the Entrant which does not infringe any rights (including intellectual property rights) of any third party. A breach of the warranty set out in this condition by an Entrant will result in the Entry being invalid. In addition, each Entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter arising from that Entrant’s breach of the warranty set out in this condition.

  1. Game of skill: The Competition is a game of skill, chance plays no part in determining the Winner and each validly submitted Entry will be individually judged by representatives of the Promoter on the basis of originality and creativity, and according to any other criteria specified or adopted by the Promoter.

  2. Binding decision: A decision of the Promoter in relation to any part of the Competition, including the selection of Winners, is binding and conclusive and no correspondence will be entered into.

  3. Promotional activity: Entrants agree, at the Promoter's request, to participate in all editorial and promotional activity surrounding the Competition or the winning of any Prizes, free of charge, and they consent to the Promoter and its related entities using their name and image in promotional material including social media. Without limitation, Entrants consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this Competition, or in taking or using any Prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time. Each Winner grants the Promoter (and will procure that their guest grants, if applicable) a perpetual, non-exclusive, worldwide licence to use such footage and photographs in all media forms whatsoever

  4. Proof of identity: All Entrants agree to provide the Promoter with proof of identity, residency and/or age, and/or proof of entry validity upon request by the Verification of such proof is at the sole discretion of the Promoter. In the event that a Winner cannot provide suitable proof of identity, residency, age or Entrant validity that Winner will forfeit the Prize in whole and no substitute will be offered.

  5. Prizes non-transferable: Prizes are not transferable or redeemable for cash. The Prizes or any element of the Prizes cannot be exchanged for any other Prizes.

  6. No expenses: Any expenses incurred in the course of, or associated with accepting, taking or using a Prize, including taxes will be the sole responsibility of the Winners.

  7. No warranties: Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the states and territories of Australia (Non Excludable Guarantees). Except for any liability that cannot be excluded, including any Non- Excludable Guarantees, the Promoter (including its respective officer, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including without limitation the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of  the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax liability incurred by a Winner; or (f) a Prize or use of a Prize.

  8. No responsibility: No responsibility will be taken by the Promoter for any changes in dates, times or cancellations or other arrangements beyond the reasonable control of the Promoter that may prevent a Winner from accepting, taking or using a Prize.

  9. Disqualifications: The Promoter may, in its absolute discretion, disqualify:

  1. any Entrant that submits an Entry which is not original, is not completed in accordance with these terms, infringes the intellectual property rights of any third party, contains any objectionable or poor quality content, or has the potential to damage the reputation of any person;

  2. any individual who tampers with the Entry process, submits an Entry that is not in accordance with these terms, or who has in the opinion of the Promoter, engaged in unlawful or improper conduct that is designed to, or is likely to, adversely affect the fair and proper conduct of the Competition or is generally damaging to the goodwill or reputation of the Promoter.

  1. Varying the Competition: If the Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to suspend, cancel, vary or terminate the Competition, or cancel, vary or withdraw its Prizes. If the Promoter cancels or varies the Competition, or cancels, varies or withdraws its Prizes, the Promoter is not:

  1. liable to any person for any costs, loss or damage whatsoever arising out of, or in connection with, such

cancellation, variation or withdrawal; or

  1. required to conduct the Competition at any other time.

  1. Entry error: The Promoter accepts no responsibility for late, lost, incorrectly submitted or misdirected entries, for any technological malfunction or failure, internet traffic congestion, or for out-dated or incorrect contact details by which the Entrant cannot be contacted during business hours on relevant dates.

  2. Beefmaster, Outermark, Coles Group are in no way associated or affiliated with this Promotion and all trademarks are the property of their respective owners.
